These Terms of Use govern the iOS and Android games published by Machware Games, the games unit of Machware Teknoloji A.Ş. (as an end-user licence agreement), and the use of the games.machware.com.tr website. Each game's page also has terms specific to that game; they supplement these terms and prevail for that game in case of conflict.
Parties and acceptance
The services are provided by Machware Teknoloji A.Ş., Maslak Mah. Maslak 42 B Blok İç Kapı 542, Sarıyer/İstanbul, MERSIS number: [TO BE COMPLETED], email: support@machware.com.tr ("Machware", "we"). By downloading, installing or playing a game, or by using the website, you accept these terms. If you do not accept them, please do not use our games or the site.
Game licence
We grant you a personal, non-commercial, worldwide, non-transferable, non-sublicensable, non-exclusive and revocable licence to use our games. The games are licensed to you, not sold. The licence covers use on devices you own or control, as permitted by the usage rules of the store you got the game from.
App Store and Google Play
- Apple App Store: if you downloaded a game from the App Store, Apple's Standard Licensed Application End User License Agreement (Standard EULA) applies unless a separate licence agreement is provided. These terms supplement the Standard EULA to the extent they do not conflict with it. The licence is between you and Machware only; Apple is not the provider of the game or its content and is not responsible for the game's maintenance and support or for claims relating to it (including product liability, legal compliance and intellectual property infringement claims). Apple and its subsidiaries are third-party beneficiaries of this licence.
- Google Play: if you downloaded a game from Google Play, the Google Play Terms of Service also apply.
- Matters related to your store account (payment method, family sharing, subscription management) are governed by that store's rules.
Age
Our games are designed for users aged 13 and over and are not directed at children under 13. If you are a minor in your country, use our games and their purchase features with your parent's or guardian's permission and supervision.
Acceptable use
You agree not to:
- cheat in the games, or use or distribute cheats, bots or unauthorised third-party software,
- deliberately exploit bugs to gain an unfair advantage for yourself or others,
- decompile, reverse engineer or modify the games, except where mandatory law allows it,
- artificially inflate ad impressions or clicks, or manipulate the ad system,
- copy, rent, sell, redistribute or commercially exploit the games or their content,
- overload the site or forms by automated means, attempt to bypass security measures, or submit misleading information or someone else's details through the forms.
If you break these rules we may suspend or end your licence.
Ads
Some of our games are free and show ads served by Google AdMob. Ads are third-party content; we are not responsible for advertisers' products, services or websites. Personalised ads and consent settings are explained in our Privacy Policy.
In-app purchases and refunds
- Some games offer optional in-app purchases. The price, including taxes, is shown in the store before you buy. Apple or Google collects and processes the payment, and purchases are subject to that store's terms. We never see your payment details.
- Virtual items, in-game currencies and features have no real-money value, cannot be exchanged for money or goods, cannot be transferred outside the game and are licensed to you only for use in the game.
- Permanent purchases can be restored with the same store account through the game's "Restore purchases" option. Consumable items are not restored once used.
- Refunds are requested directly from the store, under the store's rules; Machware cannot see the payment and cannot issue refunds. Use Request a refund from Apple for the App Store and Google Play refund policies for Google Play.
- For digital content supplied immediately, the right of withdrawal may no longer be available once supply has begun with your consent (Turkish Consumer Protection Law No. 6502 and Distance Contracts Regulation art. 15(1)(ğ); in the EU, Directive 2011/83/EU art. 16(m)). Your other mandatory consumer rights, including for defective performance, are not affected. If an item you bought did not arrive, write to us through the support page with the transaction number and your Player ID or Support code.
Game data, updates and end of service
Our games have no username-and-password accounts. Your progress is stored on your device and, if the game supports it, also in an anonymous player profile tied to your installation on our game server (see the game-specific privacy policy). If you delete the game, the progress on the device may be lost. We may update the games, add or remove content and end support for certain devices or operating system versions. If we stop offering a game, we will announce it in the game or on the site reasonably in advance. You can ask for your data to be deleted on the Data Deletion Request page.
Use of the website
This site is published to present our games and to provide legal texts and the support and request forms. Information on the site is for general information and may change without notice. We are not responsible for the content of third-party sites we link to. You are responsible for the accuracy of what you submit through the forms. Personal data you submit in the forms is processed under our Privacy Policy and KVKK Information Notice.
Intellectual property
The code, design, graphics, characters, music and sounds, texts of the games and the site, and the "Machware" and "Machware Games" brands belong to Machware or its licensors and are protected by intellectual property law. No rights are transferred to you other than the licence expressly granted in these terms. Apple, App Store, Google Play and related logos are trademarks of their owners.
Warranty and liability
We build our games with care, but we cannot guarantee that they will run without interruption or errors, and to the extent permitted by mandatory law they are provided "as is". To the extent permitted by mandatory law, we are not liable for indirect damage or loss of profit. This limitation does not cover liability for intent or gross negligence (Turkish Code of Obligations No. 6098 art. 115), harm to life and health, or the rights you have as a consumer that cannot be limited by contract.
Ending the licence
You can end the licence at any time by removing the game from your device. We may end your licence if you seriously breach these terms. When the licence ends you must stop using the game. Provisions that by their nature should survive (intellectual property, liability, governing law) remain in force.
Changes
We may update these terms when our services or the law change. The current version and date are shown at the top of this page, and earlier versions are listed at the bottom. We announce significant changes in the games or on the site before they take effect. If you keep using the games after a change, you accept the updated terms.
Governing law and disputes
These terms are governed by the laws of the Republic of Türkiye. For disputes with users who are not consumers, the Istanbul (Çağlayan) Courts and Enforcement Offices have jurisdiction. Consumers may apply, within the monetary limits of Law No. 6502, to the Consumer Arbitration Committee of their place of residence or of the place of the transaction. For disputes outside the Committee's remit, mediation is mandatory before filing a case at the Consumer Court (Law No. 6502 art. 73/A; a precondition to suit). Consumers habitually resident in the EU/EEA keep the protection of the mandatory consumer law of their country of habitual residence.
